Please read these Terms carefully. They apply to the Orbit Labbs website and our apps Weightoo, T-gain, and Playwayk. By downloading, accessing, purchasing, or using a Service, you agree to these Terms to the extent permitted by applicable law.
1. Agreement to these Terms
These Terms & Conditions ("Terms") are an agreement between you and Orbit Labbs ("Orbit Labbs", "we", "us", or "our") governing your access to and use of the Orbit Labbs website and our applications Weightoo, T-gain, and Playwayk, including their content, features, subscriptions, updates, and related support (collectively, the "Services").
By using a Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Mandatory consumer rights that cannot lawfully be waived remain unaffected.
2. Eligibility
You may use the Services only if you are legally permitted to do so under the laws that apply to you. If you are below the age at which you can independently agree to these Terms in your jurisdiction, a parent or legal guardian must review and agree to them where required by law. Certain health, wellness, purchase, or account features may be unsuitable for younger users.
3. Accounts and account security
Some Services may allow or require an account. You agree to provide accurate information, keep your sign-in credentials secure, and notify us if you believe your account has been accessed without permission. You are responsible for activity conducted through your account to the extent permitted by law.
We may use third-party sign-in services where offered. Your use of those sign-in services may also be subject to the provider's separate terms.
4. App-specific terms
WEIGHTOO
Weight loss without guaranteed outcomes
Weightoo is a general lifestyle and weight-management companion. It may help you record progress, create routines, follow habits, view trends, and use informational or AI-assisted features. Weightoo does not guarantee a particular amount or rate of weight loss, and individual results vary based on many factors beyond the app's control.
Weightoo is not a medical device, medical provider, registered dietitian, or substitute for individualized medical care. Information in the app should not be used to diagnose, treat, cure, or prevent a disease or medical condition.
T-GAIN
Men's wellness, not hormone treatment
T-gain is a lifestyle and men's wellness product intended to support routines, habits, consistency, and general informational content. T-gain does not measure testosterone, diagnose low testosterone, guarantee an increase in testosterone, prescribe medication, or replace laboratory testing or professional medical evaluation.
Any educational content about sleep, exercise, nutrition, habits, or men's wellness is general information only. If you have symptoms, medication questions, fertility concerns, hormone concerns, or a medical condition, consult a qualified healthcare professional.
PLAYWAYK
Alarm and challenge reliability
Playwayk is an alarm app designed to make waking up more engaging by requiring a game or challenge to dismiss an alarm. Alarm delivery can be affected by battery optimization, permissions, focus or do-not-disturb settings, device volume, operating-system behavior, device shutdown, software bugs, hardware failure, or other circumstances outside Orbit Labbs' control.
Do not use Playwayk as your only alert mechanism for emergencies, medication, medical monitoring, travel departure, examinations, work shifts, safety-critical duties, or other high-consequence situations. If a challenge involves physical movement, use it only when you can do so safely and without creating a risk to yourself or others.
5. Health and wellness disclaimer
Weightoo and T-gain, and some informational features in other Orbit Labbs products, may discuss fitness, habits, weight, sleep, nutrition, motivation, wellness, or related topics. The Services are intended for general informational, educational, tracking, and lifestyle purposes only. They do not provide medical diagnosis, emergency assistance, treatment, or professional healthcare advice.
Before making a significant change to diet, exercise, weight-management practices, supplements, medication, hormone-related decisions, or other health behavior, consider your individual circumstances and consult a qualified professional when appropriate. Never ignore professional medical advice or delay seeking it because of content shown in an Orbit Labbs Service.
6. No emergency use
The Services are not emergency services and are not designed to contact medical providers, emergency responders, or other authorities. If you believe you are experiencing a medical or safety emergency, use the emergency resources available in your location rather than relying on an Orbit Labbs app.
7. Your responsibility for decisions
You are responsible for how you use information, goals, calculations, reminders, trends, AI output, alarms, and other content provided through the Services. You should verify important information and use reasonable judgment before acting on it. Results, recommendations, estimates, projections, and generated content can be incomplete, inaccurate, or unsuitable for your specific situation.
8. Paid features, subscriptions, and trials
Some Orbit Labbs Services may offer subscriptions, free trials, one-time purchases, or other paid features. The applicable price, currency, billing period, trial period, and included features are displayed before you confirm a purchase. Taxes may apply depending on your location and the store through which you purchase.
If a subscription is described as automatically renewing, it will continue to renew until cancelled in accordance with the purchase platform's rules. Unless otherwise stated by the store, deleting an Orbit Labbs app does not automatically cancel an active subscription.
For purchases made through Apple App Store or Google Play, billing, cancellation, refunds, payment disputes, and subscription management are generally handled by the applicable store and are also subject to that store's terms. Orbit Labbs cannot directly modify every store-managed payment or refund decision.
9. Free trials and promotional offers
A trial or promotional offer may be available only to eligible users and may be limited by platform rules, account history, territory, or other conditions shown at the time of offer. Unless you cancel before the trial ends where required, a trial may convert to the displayed paid subscription. The purchase screen and platform confirmation govern the specific commercial terms of your offer.
10. AI-generated or AI-assisted content
Certain Services, including features that may be available in Weightoo, can use artificial intelligence. AI output is generated automatically and may contain errors, omissions, outdated information, or content that does not fit your circumstances. AI output is not guaranteed to be accurate, complete, unique, or suitable for any particular purpose.
You must not rely on AI output as medical advice, diagnosis, emergency guidance, legal advice, financial advice, or any other regulated professional service. You are responsible for reviewing and evaluating output before using it.
11. License to use the Services
Subject to these Terms, Orbit Labbs grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use our apps for your own lawful personal use on devices you own or control, subject to applicable app-store rules. No ownership interest in the Services is transferred to you.
12. Acceptable use
You agree not to:
use the Services for unlawful, fraudulent, abusive, harassing, or harmful conduct;
attempt to gain unauthorized access to accounts, systems, servers, databases, or networks;
reverse engineer, decompile, disassemble, copy, scrape, or extract source code except to the limited extent applicable law expressly allows;
upload malware, exploit code, automated abuse, or content intended to disrupt the Services;
interfere with the operation or performance of the Services or another user's use;
use Orbit Labbs branding, app names, logos, or content in a misleading way or to impersonate Orbit Labbs;
use the Services to violate another person's privacy, intellectual-property rights, or other legal rights; or
use automated systems to access the Services at a volume or manner that creates unreasonable load or is inconsistent with ordinary consumer use.
13. User content and data you provide
You retain ownership of content and information you provide through the Services. You grant Orbit Labbs a limited license to host, store, process, reproduce, transmit, and otherwise use that content only as reasonably necessary to provide, secure, support, and improve the Services, consistent with our Privacy Policy.
You represent that you have the rights needed to provide any content you submit and that doing so does not violate law or another person's rights.
14. Intellectual property
Orbit Labbs and its licensors retain all rights in the Services, including software, source code, product design, interfaces, graphics, text, logos, product names, animations, audio, documentation, and other materials. Orbit Labbs, Weightoo, T-gain, and Playwayk, together with associated branding, may not be copied or used in a way that suggests sponsorship or affiliation without permission.
15. Feedback
If you voluntarily send suggestions, ideas, bug reports, feature requests, or other feedback, you allow Orbit Labbs to use that feedback without restriction or payment to you, provided we do not publicly attribute private feedback to you without permission.
16. Third-party services and app stores
The Services may rely on or link to third-party platforms, app stores, authentication providers, cloud services, analytics providers, AI providers, payment systems, or websites. Orbit Labbs does not control every third-party service and is not responsible for third-party terms, content, availability, or independent privacy practices. Your use of third-party services may be governed by separate agreements.
17. Updates and changes to the Services
We may release updates that change features, interfaces, compatibility, pricing, requirements, or functionality. We may also add, remove, suspend, limit, or discontinue a feature or Service when reasonably necessary for product, security, legal, technical, or business reasons. Some updates may be necessary for the app to continue functioning properly.
18. Availability and compatibility
We do not guarantee that every Service will be available in every country, on every device, or on every operating-system version. Features may differ between iOS, Android, web, territories, subscription tiers, and app versions. Internet access, device permissions, third-party services, and compatible hardware may be required for some functionality.
19. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you materially violated these Terms, created a security risk, abused a Service, failed to pay a required charge, or if suspension is necessary to comply with law or protect users, third parties, or Orbit Labbs. Where appropriate, we may provide notice or an opportunity to resolve the issue.
20. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. Orbit Labbs does not make warranties that the Services will always be uninterrupted, error-free, secure, accurate, compatible with every device, or capable of producing a particular health, wellness, weight-loss, testosterone-related, productivity, sleep, or waking outcome.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
21. Limitation of liability
To the maximum extent permitted by law, Orbit Labbs will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, opportunity, goodwill, sleep, productivity, or business arising out of or related to the Services, even if we have been advised that such loss may occur.
Without limiting the app-specific disclaimers above, Orbit Labbs is not responsible for consequences caused by a missed or delayed Playwayk alarm where the failure results from device settings, unavailable permissions, operating-system restrictions, device shutdown, network or hardware conditions, or other circumstances outside our reasonable control.
Where applicable law does not allow a limitation or exclusion, Orbit Labbs' liability will be limited only to the maximum extent legally permitted. Nothing in these Terms excludes liability that cannot legally be excluded.
22. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold Orbit Labbs harmless from claims, losses, damages, liabilities, and reasonable costs arising from your unlawful use of a Service, your material violation of these Terms, or your infringement of another person's rights. This section does not apply where prohibited by consumer-protection law.
23. Privacy
Our Privacy Policy explains how information is handled when you use Weightoo, T-gain, Playwayk, and the Orbit Labbs website. By using the Services, you acknowledge that your information will be handled as described there, subject to applicable law.
24. Governing law and disputes
These Terms are governed by the laws that validly apply to the relationship between you and Orbit Labbs, without reducing mandatory consumer protections available in your place of residence. Before starting formal proceedings, we encourage you to contact us at contact@orbitlabbs.com so we can attempt to resolve the issue informally.
Nothing in these Terms prevents you from using a court, regulator, consumer-protection body, or dispute process that you are legally entitled to use.
25. App-store terms
If you download a Service through Apple App Store or Google Play, the applicable store's terms may also apply. If these Terms conflict with mandatory app-store requirements, the mandatory store requirements control to the extent of the conflict.
26. Changes to these Terms
We may update these Terms as our apps, business, or legal obligations change. The current version will be posted on this page with a revised date. If a change materially affects your rights and applicable law requires additional notice or consent, we will provide it. Continued use after an effective update constitutes acceptance to the extent permitted by law.
27. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law, and the unenforceable provision will be interpreted or modified as closely as legally possible to its intended purpose.
28. No waiver
If Orbit Labbs does not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it later.
29. Entire agreement
These Terms, together with the Privacy Policy and any app-specific purchase terms or notices presented to you, form the agreement between you and Orbit Labbs regarding your use of the Services, except where another written agreement expressly applies.
